Fence Permits and Height Rules in Birmingham, AL
Before a new fence goes up in Birmingham, there are a few rules to get right: the city permit, height limits, which materials go where, and, in many neighborhoods, HOA approval. This guide from Birmingham Fence Pros explains the basics. We handle the permit on every fence we build, but it helps to know the rules before you choose a design.
Does Birmingham Require a Fence Permit?
Yes. The City of Birmingham requires a zoning permit for any construction or repair of a fence or wall, according to the city's Code Enforcement Resource Guide. The fee is set by the City Council and can change, so check with the city for the current amount. Permits are handled by the city's Department of Planning, Engineering and Permits.
This applies inside Birmingham city limits. Homewood, Mountain Brook, Vestavia Hills, Trussville, and the other cities around Birmingham are separate cities with their own permit rules. Unincorporated areas fall under Jefferson County.
Height Limits in Birmingham
The city's Code Enforcement Resource Guide sets these limits:
Front yard
- Up to 4 feet tall in a front yard, which the city defines as any yard facing a street.
- An additional foot is allowed for decorative features at the top of the fence.
Side and rear yards
- Up to 8 feet tall.
- An additional foot is allowed for features at the top of the fence.
What this means for your fence
A 6-foot privacy fence belongs in the side and back yard. In the front yard, a 3 to 4-foot picket, aluminum, or iron fence fits the rule, and the zoning ordinance also says front-yard fences shouldn't be opaque. Corner lots face two streets, so both of those sides count as front yards.

Materials: What Goes Where
The city's guide also spells out material rules:
- Chain link fences are not allowed in a front yard.
- Natural wood is permitted in front, side, and rear yards.
- The finished side of the fence must face the neighboring property and the street.
- Barbed wire and razor wire are allowed only in rear yards, and only in commercial, industrial, and manufacturing districts.
- Electrified fences are prohibited in all yards.
- Fences built from pallets are prohibited.
- Fences must be kept upright and free of missing or broken parts.
Sight Lines at Driveways and Corners
Fences, walls, and plantings can't block the view of traffic. Near driveways, alleys, and street corners, that may mean a lower or more open fence, or holding the fence back from the corner.
Floodplains
If part of your property is in a regulatory floodplain, a fence or wall there needs a separate Permit to Develop in a Flood Hazard Area in addition to the fence permit. Solid fences can block floodwater, so the city reviews these separately.
HOA Rules
Many neighborhoods in Birmingham and the Over the Mountain cities have HOA covenants that go further than city rules. Common HOA limits:
- Approved materials and colors
- Maximum heights lower than city limits
- Which side of the fence faces out (often the finished side faces the neighbors or the street)
- Approval before any work starts
Get HOA approval in writing before scheduling. We can provide drawings and material specs for your HOA submission.
Property Lines and Surveys
A fence built on the wrong side of the line can lead to a dispute or a costly move later. Before building:
- Find your property pins or check a recent survey
- If the line is unclear, consider having it surveyed
- Talk to your neighbor if the fence runs along a shared line
Many homeowners set the fence slightly inside their own line to avoid problems.
